Welcome to LocalBiz!

These Terms of Service ("Terms") govern your access to and use of the LocalBiz website located at https://localbiz.ai (the "Website") and the services provided by LocalBiz ("we," "us," or "our"). By accessing or using the Website and our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or services.

1. Description of LocalBiz

LocalBiz is a software-as-a-service (SaaS) platform designed to help local service businesses improve their local SEO through AI-assisted creation of blog posts, SEO pages, and images, plus keyword rank tracking and related tools. LocalBiz can also generate a complete website for your business and deliver it to code and hosting accounts that you own (see Section 3a); LocalBiz does not host websites. Usage is paid for with credits (see Section 4).

2. Account Eligibility and Use

By using LocalBiz, you represent that you are at least 18 years old and capable of entering into a legally binding agreement. You agree to provide accurate and complete information when creating an account and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Ownership, License, and Refunds

When you purchase a package from LocalBiz, you are granted access to generate blog posts and SEO-related content for your own business use.

* You own the blog posts and generated content you create using LocalBiz.
* You may use the content for personal or commercial business purposes.
* You may not republish or resell the LocalBiz platform itself, and you may not use generated content to operate a competing service.

We offer a full refund if requested within 7 days of purchase and before any content has been generated, provided the request complies with our refund process. Once content has been generated, all sales are final.

This cash refund policy is separate from automatic credit refunds: when an individual generation fails, the credits reserved for it are returned to your credit balance automatically (see Section 4). Failed generations are compensated in credits, not cash.

3a. Generated Websites

LocalBiz can generate a complete website for your business. The following terms apply specifically to generated websites and supersede any conflicting general terms in this document.

Discontinued hosted tier: LocalBiz previously offered a "Software + Website" subscription tier that included a WordPress website hosted by us through a hosting partner. That tier is discontinued and is no longer sold or provisioned. The terms below replace it in full.

What You Receive, and Where It Lives

Website generation produces the complete source code of a custom website. That code is delivered to infrastructure you own and control:

- Once you connect your GitHub account by installing our GitHub application, the source code is committed to a code repository in your own GitHub account. If you generate before connecting, we hold the code for you as the private snapshot described under "Working Copies" below, and it is committed to your repository when you connect.
- Once you also connect your Vercel account (which requires the GitHub connection), the site is deployed to your own Vercel account, under your own hosting plan.

We do not host your website. We do not provide a subdomain, a server, or an SSL certificate, and we have no ability to take your website offline.

You must have, or create, a GitHub account and a Vercel account, and you must authorize LocalBiz to act on them by installing our GitHub application and connecting your Vercel account. Those accounts are governed by GitHub's and Vercel's own terms of service and pricing, which are between you and them. We are not responsible for their availability, pricing, policy changes, or for any account suspension or termination they impose. Any hosting, bandwidth, or usage charges those providers bill you are yours to pay and are separate from your LocalBiz subscription.

You may revoke our access at any time from your GitHub or Vercel account. Doing so does not affect your website, which continues to run on your own infrastructure; it only stops LocalBiz from publishing further changes to it.

Ownership

You own the generated website outright — the source code and the content — from the moment it is created. Once you have connected your GitHub and Vercel accounts, it lives in a repository and a hosting account that are also yours, and there is nothing for us to release, transfer, or withhold. Until you connect, your generated code exists as your private snapshot with us, and connecting your accounts is how you take delivery of it.

Cancelling or downgrading your LocalBiz subscription does not remove, disable, or degrade your website. It stops us from generating new content or publishing further changes. Your live site keeps running for as long as you maintain your own hosting account.

You grant us a non-exclusive, worldwide, royalty-free license to store, transmit, cache, and process your site's content and source code for the sole purpose of operating the generation, preview, and publishing features you have asked us to perform.

Working Copies

We retain a private working copy (a "snapshot") of your generated site in order to power the in-app preview, to allow you to restore an earlier version, and to resume work between sessions. Snapshots are stored privately and are not published, shared, or made publicly accessible. They are a convenience feature and are not a backup service: once you have connected GitHub, your authoritative copy is the repository in your own GitHub account, which you can clone, export, or back up at any time by means entirely independent of LocalBiz. Before you connect, the snapshot is the only copy of your generated site, so we encourage you to connect GitHub promptly after generation.

Domains

We do not register, sell, or transfer domain names. You are responsible for purchasing and maintaining your own domain through a third-party registrar (e.g., GoDaddy, Namecheap, Cloudflare), and for keeping its DNS records accurate. We are not responsible for downtime, lost traffic, lost search ranking, or any other consequence resulting from DNS misconfiguration, domain expiry, or registrar action.

Publishing

Blog posts and pages you approve within LocalBiz can be published to your generated website. We do not guarantee any particular publishing latency, ordering, or formatting fidelity between the LocalBiz editor and the live site. We reserve the right to retry, re-order, or defer publishing operations as required to maintain platform stability.

If your GitHub or Vercel connection stops working — because access was revoked, a repository was deleted, renamed, or transferred, or the provider suspended the account — publishing will stop. We will attempt to notify you by email, but restoring the connection is your responsibility, and we are not liable for content that was not published while a connection was broken.

Generation and Credits

Website generation, edits, and publishing consume credits as set out in Section 4. If a generation fails, the credits reserved for it are automatically returned to your balance. As stated in Section 3, failed generations are compensated in credits, not cash.

Generated content is produced by automated systems and may contain errors, inaccuracies, or omissions. You are responsible for reviewing your website before and after it goes live, and for ensuring its content is accurate, lawful, and appropriate for your business — including any claims about licensing, certification, pricing, availability, or guarantees.

Service Availability

Website generation depends on third-party infrastructure — including AI providers, code hosting, and deployment platforms — which is outside our direct control. We will use commercially reasonable efforts to keep the generation service available, but we do not guarantee any specific uptime, turnaround time, or performance level. We are not liable for any business loss, lost revenue, lost ranking, or other damages arising from generation failures, publishing delays, or service interruption.

Acceptable Use of Generated Websites

You may not use LocalBiz to generate or publish a website that:
- Contains content violating any law in your jurisdiction or the United States
- Contains adult content, gambling content, illegal pharmaceutical content, or content prohibited by the acceptable use policy of GitHub, Vercel, or any other provider in the delivery path
- Impersonates another business, person, or organization
- Operates a competing website-building, hosting, or local-SEO service

We reserve the right to suspend or terminate your access to the generation service for violations of these terms, with or without notice depending on severity. Because your website runs on your own infrastructure, such a suspension stops future generation and publishing but does not take your existing site offline.


Attribution: every website built with the website builder displays a "Powered by LocalBiz" link to localbiz.ai in its footer. This attribution is part of the service, is present on every page, and cannot be removed or hidden through the website builder.

4. Credits and Billing

LocalBiz is sold as a monthly credit subscription. A "credit" is the unit used to pay for AI generation work on the platform. Credit plans differ only in price, monthly credit amount, and keyword-tracking allowance; every plan can use every feature.

Cost per action:
- Blog post generation: 3 credits
- SEO page generation: 2 credits
- Image generation or regeneration: 1 credit per image (including the images generated with a new blog post or page)

Website actions (see Section 3a) also consume credits:
- Initial website generation (your homepage): 14 credits
- Website edit prompt: 1, 3, or 10 credits depending on the size of the change (small, standard, or large). The exact price is shown before you confirm, and you are never charged more than the price shown.
- Adding an approved blog post or page to your live website: 5 credits
- Removing a page from your live website: free

Multi-language content: each additional language version of generated content is generated separately and costs that action's credit price again. For example, an initial website generation (14 credits) in two additional languages costs 42 credits in total (14 + 14 + 14). Website edit prompts and adding or removing content on your live website are charged flat, regardless of how many languages your site has.

Monthly grants and rollover: each billing period, your plan's monthly credit amount is added to your balance. Unused credits roll over while your subscription is active, up to a maximum balance of 2x your plan's monthly amount; credits that would push your balance above that cap are not added.

No free trial: credit plans do not include a free trial.

Cancellation and forfeiture: when your subscription ends (whether canceled by you or by us), any remaining credit balance is forfeited. Credits have no cash value and cannot be transferred, sold, or redeemed for cash.

Plan changes: when you upgrade to a higher plan, the price difference is charged immediately on a prorated basis, and the difference between the two plans' monthly credit amounts is added to your balance immediately (subject to the rollover cap). When you downgrade, your current plan and price remain in effect until the end of your billing period; the new plan's price and monthly credit amount apply from your next renewal. Downgrading never removes credits already in your balance.

Keyword rank tracking allowance: each plan includes a pooled allowance of keyword rank checks (keyword x location combinations), shared across all businesses you own. If a plan change leaves you above your allowance, keywords you already track keep being tracked; you simply cannot add new ones until you are back under your plan's allowance (by removing tracked keywords or upgrading).

Failed generations: if a generation fails, the credits reserved for it are automatically returned to your balance.

Acceptable use of credits: credits are for creating local-business marketing content (blog posts, SEO pages, images, and websites) for businesses you manage on LocalBiz. Credits are not a general-purpose AI service and may not be used to mass-produce content unrelated to your businesses. We reserve the right to suspend accounts that abuse the credit system.

5. User Data and Privacy

We collect user data including name, business information, email address, and payment information as necessary to provide our services.

6. Non-Personal Data Collection

LocalBiz uses web cookies and similar technologies to collect non-personal data for analytics, functionality, and service improvement purposes.

7. Acceptable Use

You agree not to use the Website or services for any unlawful purpose, to violate any applicable laws or regulations, or to interfere with the operation or security of the platform. We reserve the right to suspend or terminate access for violations of these Terms.

8. Disclaimer of Warranties

LocalBiz is provided on an "as is" and "as available" basis. We make no guarantees regarding specific SEO results, rankings, traffic increases, or business outcomes. Results may vary based on numerous factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, LocalBiz shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Website or services.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

11. Updates to the Terms

We may update these Terms from time to time. When changes are made, users will be notified via email, and the updated Terms will be posted on this page with a revised "Last updated" date.
