These Terms of Service ("Terms") govern your access to and use of the LocalBiz website located at https://localbiz.ai (the "Website") and the services provided by LocalBiz ("we," "us," or "our"). By accessing or using the Website and our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or services.

1. Description of LocalBiz
LocalBiz is a software-as-a-service (SaaS) platform designed to help local service businesses improve their local SEO through automated Local SEO blog creation and related tools.

2. Account Eligibility and Use
By using LocalBiz, you represent that you are at least 18 years old and capable of entering into a legally binding agreement. You agree to provide accurate and complete information when creating an account and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Ownership, License, and Refunds
When you purchase a package from LocalBiz, you are granted access to generate blog posts and SEO-related content for your own business use.
* You own the blog posts and generated content you create using LocalBiz.
* You may use the content for personal or commercial business purposes.
* You may not republish or resell the LocalBiz platform itself, and you may not use generated content to operate a competing service.
We offer a full refund if requested within 7 days of purchase and before any content has been generated, provided the request complies with our refund process. Once content has been generated, all sales are final.

3a. Hosted Websites (Software + Website Tier)
Customers on the "Software + Website" subscription tier ($149/month per account) receive a fully-hosted WordPress website provisioned through our hosting partner. Subscriptions created prior to May 2026 may remain on a previous price ($169/month) for the lifetime of that subscription. The following terms apply specifically to hosted websites and supersede any conflicting general terms in this document.
Provisioning and Live Sites
When you upgrade an account to the Software + Website tier, we will provision a new WordPress website on a subdomain we provide. You may later attach a custom domain you own, subject to verifying control of that domain through DNS configuration. We do not register, sell, or transfer domain names — you are responsible for purchasing and maintaining your own domain through a third-party registrar (e.g., GoDaddy, Namecheap, Cloudflare).
You are responsible for keeping the DNS records at your registrar accurate and pointing at the values we provide. We are not responsible for downtime, lost traffic, lost SEO ranking, or any other consequence resulting from DNS misconfiguration on your end.
Content Synchronization
Foundation pages and blog posts you create within LocalBiz will be automatically published to your hosted website. We do not guarantee any particular publishing latency, ordering, or formatting fidelity between the LocalBiz editor and the live site. We reserve the right to retry, re-order, defer, or skip publishing operations as required to maintain platform stability.
You retain ownership of all content you create. We retain a non-exclusive, worldwide, royalty-free license to host, transmit, cache, back up, and display that content for the sole purpose of operating the hosted website service.
Backups
Daily backups of your hosted website are taken automatically and retained for 60 days for compliance and operational purposes only. These backups are not user-accessible.
You are responsible for downloading your own copy of any content you wish to retain outside our platform. We provide a self-service backup download tool from within your dashboard at any time during the active subscription and during the 30-day grace period (defined below). After the grace period expires, you will not be able to retrieve content from your hosted website, regardless of any compliance backups we may still hold internally.
Downgrade Grace Period
If you downgrade an account from the Software + Website tier back to the Software-only tier, OR cancel your subscription entirely, your hosted website will remain live for a 30-day grace period beginning at the end of your then-current billing period.
During the grace period:
- Your website continues to serve your existing visitors
- The LocalBiz dashboard displays a countdown banner
- We will send you reminder emails at T-21, T-14, T-7, and T-1 days before deletion
- You may re-upgrade at any time to cancel the scheduled deletion
- You may download a complete backup of your site at any time
After the grace period expires, your hosted website will be permanently deleted. This includes all WordPress content, media, themes, plugins, custom domain attachments, and SSL certificates we provisioned. Deletion is permanent and cannot be reversed except in limited circumstances at our sole discretion within 7 calendar days of deletion ("Support-Mediated Restore Window"). Any restore performed during this window is provided as a courtesy and is not guaranteed.
After the 7-day Support-Mediated Restore Window has elapsed, no restoration of any kind is possible. Compliance backups, where they still exist, are retained solely for our internal legal and operational purposes and cannot be released to customers or third parties.
No Refunds for Missed Grace Deadlines
You acknowledge that the 30-day grace period is a generous and clearly-communicated window. We do not provide refunds, credits, or compensation of any kind for:
- Content lost because you did not download a backup before the grace period expired
- Traffic or revenue lost due to your DNS misconfiguration
- Search engine ranking changes following site deletion or DNS changes
- Failure to receive or read our reminder emails
- Re-provisioning a previously-deleted website (which counts as a new site, not a restoration)
Service Availability
We will use commercially reasonable efforts to keep hosted websites available, but we do not guarantee any specific uptime or performance level. The hosted website service depends on third-party infrastructure (including our hosting partner) which is outside our direct control. We are not liable for any business loss, lost revenue, lost ranking, or other damages arising from website downtime, performance degradation, or service interruption.
Acceptable Use of Hosted Websites
You may not use a LocalBiz-hosted website to:
- Host content that violates any law in your jurisdiction or the United States
- Host adult content, gambling content, illegal pharmaceutical content, or any content prohibited by our hosting partner's acceptable use policy
- Send unsolicited bulk email or operate a mail server
- Run a competing website-building, hosting, or local-SEO service
- Resell hosting capacity to third parties
We reserve the right to suspend or terminate hosted websites that violate these terms, with or without notice depending on severity. In the case of an acceptable-use termination, the 30-day grace period does not apply.

4. User Data and Privacy
We collect user data including name, business information, email address, and payment information as necessary to provide our services.

5. Non-Personal Data Collection

6. Acceptable Use
You agree not to use the Website or services for any unlawful purpose, to violate any applicable laws or regulations, or to interfere with the operation or security of the platform. We reserve the right to suspend or terminate access for violations of these Terms.

7. Disclaimer of Warranties
LocalBiz is provided on an "as is" and "as available" basis. We make no guarantees regarding specific SEO results, rankings, traffic increases, or business outcomes. Results may vary based on numerous factors outside our control.

8. Limitation of Liability
To the maximum extent permitted by law, LocalBiz shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Website or services.

9. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

10. Updates to the Terms
We may update these Terms from time to time. When changes are made, users will be notified via email, and the updated Terms will be posted on this page with a revised "Last updated" date.
